They don’t want to go to court. It’s a lot of work and it’s scary to them because they simply don’t do it. And the insurance company knows this…and will pay less than full value. If they know your lawyer likes trials and isn’t afraid to fight for you, they will pay the full settlement value. It becomes a math problem for them: they have the risk of a big verdict and they have to pay lawyers to defend the case. It’s cheaper to pay the full value than to risk getting hit for more and paying a lawyer. So, ask your potential lawyer how many cases they have tried. It is critical.
