Divorce: What does a court look at when determining custody?

Many people may wonder what a court considers when determining who will be the custodial parent of a child. The Illinois statute, 750 ILCS 5/602, lists many factors, called the Best Interest of the Child factors.  Some of those factors include:  1) the wishes of the parents, 2) the wishes of the child, 3) interaction and interrelationship with the parents and the child, 4) the child’s adjustment, 5) the mental and physical condition of all the parties involved, and 6) the physical violence or threat of violence by the child’s potential custodian.

Although these factors seem pretty straight forward, a child custody case is not simple.
