What am I entitled to when I get an annulment rather than a divorce?

When you get an annulment you are not entitled to alimony or any sort of property distribution.  An annulment is different from a divorce in the fact that divorces tend to allow for a property distribution and some sort of alimony payment, in the court’s discretion.  However, if the marriage that is being annulled includes children, the custodial parent may be entitled to receive child support from the non-custodial parent.

There are many differences between getting an annulment and getting a divorce, including procedural differences that one must take in order to obtain either one.  An annulment will treat your marriage as if it never existed, possibly preventing you from exercising certain rights you would have if you would have obtained a divorce.  If you are questioning whether you should get an annulment or a divorce, call Sheina at the Law Office of Keith Short and let her counsel and advise you on what is in your best interest.  618.254.0055.
