When will a court award me 100% custody of my kids after a divorce?

The answer to this question may surprise you.  It is highly unlikely that you will ever get 100% custody of your kids.  What many people do not realize is that custody is broken down into two parts:  physical custody and legal custody.

Primary physical custody is where the children reside with the primary custodian, usually it is either the mother or the father.  The other parent is generally entitled to have reasonable visitation.  An example of primary physical custody:  The mother keeps the children throughout the weeks and the father gets visitation every other weekend and once or twice during the week.  That being said, every case is different and this will not happen to every parent getting a divorce.

Legal custody is something completely different.  Legal custody is usually split 50/50 between the parents, although, differing facts and circumstances may change this.  That means that each parent has the right to make the big decisions when it comes to the children.  For example, the mother and the father both would be entitled to an opinion on what doctor the children should see.
