The answer to the above question is very simple: YOU SHOULD NEVER TALK TO THE POLICE WITHOUT A LAWYER PRESENT.
I had a potential client call me a few days ago and he stated that a detective called him out of the blue and told him that he already had enough evidence to get a warrant for the potential client’s arrest but if he would agree to talk with the detective, he could explain his side of the events to “clear up” the situation.
What an interesting concept. You already have enough evidence to get a warrant for my arrest but you want me to speak with you in order clear up any confusion that may currently exist.
NOOOOOOOOOOOOOOOOOOO!!! The real reason the detective wants to speak with you is to get a confession. Don’t put yourself in such a silly situation, where you are going to openly sit down with an individual whose sole purpose is to get you to say something that incriminates you.
The best practice is to say nothing.
