Will my work comp settlement reduce my social security award? / Mi acuerdo de compensacion de trabajo reducira mi premio del seguro social?
We recently resolved a client’s work comp case for just under $250,000. He ended up with a terrible spinal injury and fusion and had to leave his job. In addition to the money, we also ensured that all of the client’s medical bills were covered (another $220,000) and that he was able to get to a good social security disability (SSD) attorney. We also made sure the language of the work comp settlement protects him if he receives SSD so that there won’t be an unfair set-off of the SSD award. That sounds confusing to many people because it is…and preventing SSD from taking money out of the work comp settlement (stopping SSD from reducing your benefits because of the work comp settlement) is what we can do for you. We do not allow you to double dip (collecting twice for the same injury). It’s wrong. What we do is to structure the money so that get all of the comp settlement and you get to keep all of the SSD award the law allows you to keep. The money is spread out over time. It allows you to get on with your life after a devastating injury…and not be financially broken.
